Brazil AI Bill (PL 2338/2023)
Brazil's proposed general AI framework. The Senate-approved text takes a risk-based approach: it bans some 'excessive risk' uses, sets duties for high-risk systems (assessments, documentation, human oversight) and creates a national AI governance system. It passed the Senate in Dec 2024. Since then it has sat in a Chamber of Deputies special committee, awaiting the rapporteur's report.

What this means for you
If you build AI
- Not law yet. The Senate text would require risk assessment of AI systems before market and stricter duties for high-risk uses. The Chamber may change it; if so, it returns to the Senate.
- Watch for the Chamber special committee's rapporteur report: it will show the likely final text.
If you deploy AI
- Businesses using AI in Brazil follow existing law today (the LGPD data protection law, the consumer code). The bill would add duties for those who deploy high-risk AI.
If you use AI
- If enacted as the Senate passed it, people affected by AI decisions would gain rights to information, explanation and human review of high-risk decisions. Nothing applies yet.
